Wiley
Wiley's preeminent Communications Practice has been described by The New York Times as the brand name of communications law. Founded and led by former FCC Chairman Richard E. Wiley, the group of more than 80 attorneys and engineers is recognized for its breadth of expertise and experience, which spans virtually all aspects of the federal, state and international laws governing the media and telecommunications industry.
Their professionals include individuals who have occupied high-level positions at the FCC, the U.S. Department of State, the U.S. Department of Commerce and on Capitol Hill. These include a former Chairman of the FCC, four former FCC Commissioners, a former FCC General Counsel, two former FCC Chiefs of Staff, as well as the former U.S. Coordinator for International Communications and Information Policy (Ambassador) and a former Administrator of the National Telecommunications and Information Administration (NTIA). Others have had firsthand experience working in telecommunications firms, media companies and the advertising industry. This experience is enriched by the insights and creativity of veteran specialists in the laws governing wireless and wireline telecommunications carriers, Internet firms, broadcasters, programmers, cable and satellite operators, content producers and the print media.
The firm provides its media clients a wide array of services to address the regulatory requirements, and legal and business issues facing participants in the broadcasting, multi-channel video, print and online communications industries. The legal directory Chambers USA notes that their media team is the preeminent Washington, D.C. outfit and literally places Wiley in a category of its own for its regulatory work in this area. Their clients include broadcasters ranging from single-station licensees to major market group owners, noncommercial educational entities, financial institutions, private equity and venture capital firms and other investors, radio and television networks, websites, and other content producers and distributors.
Wiley has a longstanding relationship with APTS and has been working with the Association for several years on Incentive Auction issues, and specifically in the area of channel sharing. The firm has worked extensively to ensure public stations are aware of the costs and benefits of the auction participation. In particular, we have noted the financial difficulties that public broadcasters may face in participating in the auction through sharing arrangements, largely due to the potentially high legal costs involved in negotiating the agreements needed to implement a sharing relationship.
